Terms of Service

LemonTree is a baby activity tracking app that lets parents and caregivers manually record feeding, sleep, diaper changes, growth measurements, and other daily activities. The app also includes: • A Memories feature that lets you capture and store photos and videos of your baby's milestones, saved privately on your device. • A Stats dashboard with feeding, sleep, diaper, and growth summaries. • A data import feature that lets you bring in records from other baby-tracking apps; imported data is processed locally on your device. LemonTree is a personal logging tool only. It is not a medical device, clinical system, or health monitoring service, and it is not regulated as such.

You must be at least 18 years old to use LemonTree. By using the app, you confirm that you are a parent, legal guardian, or authorised caregiver of the child whose data you are recording, and that you have the legal right to record and share that child's data through this app.

NOTHING IN LEMON TREE — INCLUDING ANY SUMMARIES, STATISTICS, OR OTHER CONTENT — CONSTITUTES MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. All content in LemonTree is general informational guidance only and may be inaccurate, incomplete, outdated, or inapplicable to your specific situation. You must not rely on LemonTree as a substitute for professional medical advice. Always consult a qualified healthcare professional for any medical concern about your child. In an emergency, call your local emergency services immediately. Using LemonTree does not create any doctor-patient, professional, advisory, or fiduciary relationship between you and us. We expressly disclaim any liability for harm arising from reliance on any content in LemonTree.

LemonTree is a convenience and record-keeping aid only. It is not a substitute for your own attention, judgement, or direct supervision of your child. You remain solely and fully responsible for the care, safety, and well-being of your child at all times. You must never rely on LemonTree — including reminders, summaries, statistics, or schedules — to decide when or whether your child needs feeding, sleep, medication, medical attention, or supervision. Reminders and summaries may be delayed, missed, inaccurate, or absent for reasons including device, software, or network failure. To the fullest extent permitted by applicable law, you knowingly and voluntarily assume all risks arising from your use of LemonTree and from any decision you make in connection with it.

LemonTree does not monitor your child and does not detect, measure, diagnose, or alert you to any medical, safety, or emergency condition. It is not a baby monitor, a medical-alert system, or a life-safety device, and it must not be used or relied upon for any time-critical, safety-critical, or life-critical purpose. Notifications and reminders are provided on a best-effort basis only and may not be delivered. In any emergency, contact your local emergency services immediately.

LemonTree stores activity records locally on your device. You are solely responsible for the data you enter, including its accuracy and for maintaining your own backups. We are not responsible for data loss resulting from device failure, accidental deletion, app uninstallation, or any other cause. Photos and videos added to the Memories feature are stored on your device. If you do not use Family Sharing, we do not upload, access, or back up this media. You are responsible for exporting or backing up any Memories media you wish to preserve. When Family Sharing is enabled, the activity records and Memories you create — including notes, captions, and the photos and videos attached to a shared Memory — are uploaded to our servers solely to sync them to the other devices in your family group. Synced items are deleted after all devices confirm receipt. Activity records and Memory details left unconfirmed after seven days are retained in a durable snapshot (media is never kept in it); the snapshot and any remaining media are deleted when the family group is dissolved — when the last member leaves, or after a prolonged period of inactivity. See the Privacy Policy for details. We do not build profiles, sell data, or use your records or media for advertising or AI training.

The Memories feature requires access to your device's photo library to let you select photos and videos. This access is used solely to copy selected media into the app. We do not read or scan media files other than those you explicitly select, and we do not upload any Memories media to our servers unless you have enabled Family Sharing, in which case media attached to a shared Memory is relayed to your family's devices as described in Section 6. You may revoke photo library access at any time through your device's Settings. Revoking access will prevent adding new media to Memories but will not delete media already saved in the app.

You are responsible for all activity that occurs through your use of LemonTree. You agree not to: • Use the app in any way that violates applicable law or regulation. • Attempt to reverse-engineer, decompile, or tamper with the app or its backend services. • Interfere with, disrupt, or attempt to gain unauthorised access to our servers or networks. • Use the app to store or transmit content that is unlawful, harmful, or violates third-party rights. • Circumvent any security or rate-limiting mechanism. You are solely responsible for any photos, videos, or other content you add to the app. You must have the right to store and use any media you add to Memories. We reserve the right to suspend or terminate access for any user who violates these terms, without notice or liability.

We do not guarantee that LemonTree will be available at any particular time, free of errors, or that any data will be preserved. We may suspend, modify, or discontinue the service or any feature at any time, with or without notice, and without liability to you.

You may stop using LemonTree at any time. Uninstalling the app removes your local data, including any Memories media stored in the app. If you have used Family Sharing, you may leave your family group from the Settings screen. We may terminate or suspend your access at any time, for any reason, without notice or liability.

We may update these Terms at any time. When we make material changes, we will increment the version number and prompt you to review and re-accept within the app. If you do not accept updated Terms, you must stop using LemonTree. Continued use after the prompt constitutes acceptance of the updated Terms.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEMON TREE AND ITS DEVELOPERS PROVIDE THE APP AND ALL CONTENT "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: • LEMON TREE AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF LEMON TREE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. • OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS OR RELATED TO YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) USD 10 (OR LOCAL EQUIVALENT). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In those jurisdictions, our liability is limited to the minimum extent permitted by law.

You agree to defend, indemnify, and hold harmless LemonTree and its developers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the app; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) data or media you enter into the app.

You obtain LemonTree through a third-party app store (such as the Apple App Store or Google Play) and your use is also subject to that store's terms. These Terms are between you and the developer only, not with Apple Inc. or Google LLC. The app store provider is not responsible for the app or its content, and has no obligation to furnish any maintenance or support. To the maximum extent permitted by law, the app store provider has no warranty obligation and no responsibility for addressing any claims relating to the app, including product-liability, legal-compliance, or intellectual-property claims. You agree to comply with all applicable third-party terms (for example, your wireless data-service agreement) when using the app. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

These Terms are governed by the laws of the jurisdiction in which the developer is established, without regard to conflict-of-law principles. For users in mainland China, these Terms are subject to the laws of the People's Republic of China. Any dispute arising from these Terms or your use of the app will be resolved through binding arbitration or the competent courts of the applicable jurisdiction, to the extent permitted by local law. To the fullest extent permitted by applicable law, you waive any right to participate in a class-action lawsuit or class-wide arbitration against us, and you waive any right to a trial by jury.

To the fullest extent permitted by applicable law, any claim or cause of action arising out of or related to your use of LemonTree or these Terms must be commenced within one (1) year after the claim or cause of action arose. Otherwise, that claim or cause of action is permanently barred.

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labour disputes, power or internet failures, or the failure or unavailability of third-party services, networks, or infrastructure.

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and LemonTree regarding your use of the app and supersede any prior agreements.

These Terms and our Privacy Policy are provided in English, and the English version is the only authoritative one. The app's interface is available in other languages, but the legal documents are not. If we ever publish a translation, it is offered for convenience only, and the English version governs in the event of any difference.
